  1. TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION
  2. 1. Definitions.

  49. each Contributor hereby grant to Licensee permission to use the
  50. Work free of charge for any noncommercial purpose, including
  51. teaching and research at universities, colleges and other
  52. educational institutions, research at non-profit research
  53. institutions, and personal non-profit purposes. For using the
  54. Program for commercial purposes, including but not restricted to
  55. consulting activities, design of commercial hardware or software
  56. networking products, and a commercial entity participating in
  57. research projects, you have to contact the Licensor for an
  58. appropriate license. Licensee may not distribute any portion of
  59. the Work, whether in source or binary form, to any third party,
  60. except as specified in this License.
  61. 3. Submission of Contributions.
  62. Licensee agrees that any Contribution, including all data,
  63. images, sounds, text, and other things embodied therein, Licensee
  64. transmits to Licensor under this Agreement will be considered
  65. non-confidential ("Communications"). Licensor will have no
  66. confidentiality obligations with respect to the Contributions.
  67. Licensee agrees that Licensor and its designees will be free to
  68. copy, modify, create derivative works, publicly display,
  69. disclose, distribute, license and sublicense through multiple
  70. tiers of distribution and licensees, incorporate and otherwise
  71. use the Contributions, including derivative works thereto, for
  72. any and all commercial or non-commercial purposes.
  73. 4. Trademarks.
  74. This License does not grant permission to use the trade names,
  75. trademarks, service marks, or product names of the Licensor,
  76. except as required for reasonable and customary use in describing
  77. the origin of the Work and reproducing the content of the NOTICE
  78. file.
  79. 5. Disclaimer of Warranty.
  80. Unless required by applicable law or agreed to in writing,
  81. Licensor provides the Work (and each Contributor provides its
  82. Contributions) on an "AS IS" BASIS, WITHOUT WARRANTIES OR
  83. CONDITIONS OF ANY KIND, either express or implied, including,
  84. without limitation, any warranties or conditions of TITLE,
  85. NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR
  86. PURPOSE. Licensee is solely responsible for determining the
  87. appropriateness of using or redistributing the Work and assumes
  88. any risks associated with Licensee’s exercise of permissions
  89. under this License.
  90. 6. Limitation of Liability.
  91. In no event and under no legal theory, whether in tort (including
  92. negligence), contract, or otherwise, unless required by
  93. applicable law (such as deliberate and grossly negligent acts) or
  94. agreed to in writing, shall Licensor be liable to Licensee for
  95. damages, including any direct, indirect, special, incidental, or
  96. consequential damages of any character arising as a result of
  97. this License or out of the use or inability to use the Work
  98. (including but not limited to damages for loss of goodwill, work
  99. stoppage, computer failure or malfunction, or any and all other
  100. commercial damages or losses), even if Licensor has been advised
  101. of the possibility of such damages.
  102. 7. Term and Termination.
  103. The term of this License will commence on the date this License
  104. is accepted by Licensee and will continue until terminated.
  105. Licensor may terminate this License at any time, with or without
  106. cause, with written notice to Licensee. Upon termination,
  107. Licensee will immediately destroy the Work or return all copies
  108. of the Work to Licensor along with any copies Licensee has made.
  109. 8. COPYRIGHT:
  110. Title to the Work and all copies thereof remain with Universiteit
  111. Gent (‘UGent’) or the Contributors. The Work is copyrighted and
  112. protected by Belgian copyright laws and international treaty
  113. provisions. Licensee will not remove any copyright notice from
  114. the Work. Licensee agrees to prevent any unauthorized copying of
  115. the Work. Except as expressly provided herein, UGent does not
  116. grant any express or implied right to Licensee under UGent
  117. patents, copyrights, trademarks, or trade secret information.
  118. Subject to UGent’s ownership of the Work, all right, title and
  119. interest in and to Licensee’s modifications shall belong to
  120. Licensee.
