  31. Licensor. For purposes of this Public License, where the Licensed Material is a

  35. b. Adapter's License means the license You apply to Your Copyright and Similar
  36. Rights in Your contributions to Adapted Material in accordance with the terms

  38. c. Copyright and Similar Rights means copyright and/or similar rights closely
  39. related to copyright including, without limitation, performance, broadcast,

  51. material to which the Licensor applied this Public License.
  52. g. Licensed Rights means the rights granted to You subject to the terms and
  53. conditions of this Public License, which are limited to all Copyright and
  54. Similar Rights that apply to Your use of the Licensed Material and that the
  55. Licensor has authority to license.
  56. h. Licensor means the individual(s) or entity(ies) granting rights under this
  57. Public License.
  58. i. Share means to provide material to the public by any means or process that
  59. requires permission under the Licensed Rights, such as reproduction, public
  60. display, public performance, distribution, dissemination, communication, or

  68. k. You means the individual or entity exercising the Licensed Rights under this
  69. Public License. Your has a corresponding meaning.
  70. Section 2 -- Scope.
  71. a. License grant.
  72. 1. Subject to the terms and conditions of this Public License,
  73. the Licensor hereby grants You a worldwide, royalty-free,
  74. non-sublicensable, non-exclusive, irrevocable license to
  75. exercise the Licensed Rights in the Licensed Material to:
  76. a. reproduce and Share the Licensed Material, in whole or
  77. in part; and
  78. b. produce, reproduce, and Share Adapted Material.
  79. 2. Exceptions and Limitations. For the avoidance of doubt, where
  80. Exceptions and Limitations apply to Your use, this Public
  81. License does not apply, and You do not need to comply with
  82. its terms and conditions.
  83. 3. Term. The term of this Public License is specified in Section
  84. 6(a).
  85. 4. Media and formats; technical modifications allowed. The
  86. Licensor authorizes You to exercise the Licensed Rights in
  87. all media and formats whether now known or hereafter created,
  88. and to make technical modifications necessary to do so. The
  89. Licensor waives and/or agrees not to assert any right or
  90. authority to forbid You from making technical modifications

  96. 5. Downstream recipients.
  97. a. Offer from the Licensor -- Licensed Material. Every
  98. recipient of the Licensed Material automatically
  99. receives an offer from the Licensor to exercise the
  100. Licensed Rights under the terms and conditions of this
  101. Public License.
  102. b. No downstream restrictions. You may not offer or impose
  103. any additional or different terms or conditions on, or
  104. apply any Effective Technological Measures to, the
  105. Licensed Material if doing so restricts exercise of the
  106. Licensed Rights by any recipient of the Licensed
  107. Material.
  108. 6. No endorsement. Nothing in this Public License constitutes or
  109. may be construed as permission to assert or imply that You
  110. are, or that Your use of the Licensed Material is, connected
  111. with, or sponsored, endorsed, or granted official status by,
  112. the Licensor or others designated to receive attribution as

  122. 2. Patent and trademark rights are not licensed under this
  123. Public License.
  124. 3. To the extent possible, the Licensor waives any right to
  125. collect royalties from You for the exercise of the Licensed
  126. Rights, whether directly or through a collecting society
  127. under any voluntary or waivable statutory or compulsory
  128. licensing scheme. In all other cases the Licensor expressly
  129. reserves any right to collect such royalties.
  130. Section 3 -- License Conditions.
  131. Your exercise of the Licensed Rights is expressly made subject to the following
  132. conditions.
  133. a. Attribution.
  134. 1. If You Share the Licensed Material (including in modified
  135. form), You must:
  136. a. retain the following if it is supplied by the Licensor
  137. with the Licensed Material:
  138. i. identification of the creator(s) of the Licensed
  139. Material and any others designated to receive
  140. attribution, in any reasonable manner requested by
  141. the Licensor (including by pseudonym if
  142. designated);
  143. ii. a copyright notice;
  144. iii. a notice that refers to this Public License;
  145. iv. a notice that refers to the disclaimer of
  146. warranties;
  147. v. a URI or hyperlink to the Licensed Material to the
  148. extent reasonably practicable;
  149. b. indicate if You modified the Licensed Material and
  150. retain an indication of any previous modifications; and
  151. c. indicate the Licensed Material is licensed under this
  152. Public License, and include the text of, or the URI or
  153. hyperlink to, this Public License.
  154. 2. You may satisfy the conditions in Section 3(a)(1) in any

  167. Where the Licensed Rights include Sui Generis Database Rights that apply to Your
  168. use of the Licensed Material:
  169. a. for the avoidance of doubt, Section 2(a)(1) grants You the right to extract,
  170. reuse, reproduce, and Share all or a substantial portion of the contents of the
  171. database;
  172. b. if You include all or a substantial portion of the database contents in a
  173. database in which You have Sui Generis Database Rights, then the database in
  174. which You have Sui Generis Database Rights (but not its individual contents) is
  175. Adapted Material; and
  176. c. You must comply with the conditions in Section 3(a) if You Share all or a
  177. substantial portion of the contents of the database.
  178. For the avoidance of doubt, this Section 4 supplements and does not replace Your
  179. obligations under this Public License where the Licensed Rights include other
  180. Copyright and Similar Rights.
  181. Section 5 -- Disclaimer of Warranties and Limitation of Liability.
  182. a. UNLESS OTHERWISE SEPARATELY UNDERTAKEN BY THE LICENSOR, TO THE EXTENT
  183. POSSIBLE, THE LICENSOR OFFERS THE LICENSED MATERIAL AS-IS AND AS-AVAILABLE, AND
  184. MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE LICENSED
  185. MATERIAL, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHER. THIS INCLUDES, WITHOUT
  186. LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR

  202. Section 6 -- Term and Termination.
  203. a. This Public License applies for the term of the Copyright and Similar Rights
  204. licensed here. However, if You fail to comply with this Public License, then
  205. Your rights under this Public License terminate automatically.
  206. b. Where Your right to use the Licensed Material has terminated under Section
  207. 6(a), it reinstates:
  208. 1. automatically as of the date the violation is cured, provided
  209. it is cured within 30 days of Your discovery of the
  210. violation; or
  211. 2. upon express reinstatement by the Licensor.
  212. For the avoidance of doubt, this Section 6(b) does not affect any
  213. right the Licensor may have to seek remedies for Your violations
  214. of this Public License.
  215. c. For the avoidance of doubt, the Licensor may also offer the Licensed Material
  216. under separate terms or conditions or stop distributing the Licensed Material at
  217. any time; however, doing so will not terminate this Public License.
  218. d. Sections 1, 5, 6, 7, and 8 survive termination of this Public License.
  219. Section 7 -- Other Terms and Conditions.
  220. a. The Licensor shall not be bound by any additional or different terms or
  221. conditions communicated by You unless expressly agreed.
  222. b. Any arrangements, understandings, or agreements regarding the Licensed
  223. Material not stated herein are separate from and independent of the terms and
  224. conditions of this Public License.
  225. Section 8 -- Interpretation.
  226. a. For the avoidance of doubt, this Public License does not, and shall not be
  227. interpreted to, reduce, limit, restrict, or impose conditions on any use of the
  228. Licensed Material that could lawfully be made without permission under this
  229. Public License.
  230. b. To the extent possible, if any provision of this Public License is deemed
  231. unenforceable, it shall be automatically reformed to the minimum extent
  232. necessary to make it enforceable. If the provision cannot be reformed, it shall
  233. be severed from this Public License without affecting the enforceability of the
  234. remaining terms and conditions.
  235. c. No term or condition of this Public License will be waived and no failure to
  236. comply consented to unless expressly agreed to by the Licensor.
  237. d. Nothing in this Public License constitutes or may be interpreted as a
  238. limitation upon, or waiver of, any privileges and immunities that apply to the
  239. Licensor or You, including from the legal processes of any jurisdiction or
  240. authority.
