  3. READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED SUPPLEMEN
  4. TAL LICENSE TERMS (COLLECTIVELY "AGREEMENT") CAREFULLY BEFO
  5. RE OPENING THE SOFTWARE MEDIA PACKAGE. BY OPENING THE SOFT
  6. WARE MEDIA PACKAGE, YOU AGREE TO THE TERMS OF THIS AGREEMEN
  7. T. IF YOU ARE ACCESSING THE SOFTWARE ELECTRONICALLY, INDIC
  8. ATE YOUR ACCEPTANCE OF THESE TERMS BY SELECTING THE "ACCEPT
  9. " BUTTON AT THE END OF THIS AGREEMENT. IF YOU DO NOT AGREE
  10. TO ALL THESE TERMS, PROMPTLY RETURN THE UNUSED SOFTWARE TO
  11. YOUR PLACE OF PURCHASE FOR A REFUND OR, IF THE SOFTWARE IS
  12. ACCESSED ELECTRONICALLY, SELECT THE "DECLINE" BUTTON AT TH
  13. E END OF THIS AGREEMENT.
  14. 1. LICENSE TO USE. Sun grants you a non-exclusive and non
  15. -transferable license for the internal use only of the acco
  16. mpanying software and documentation and any error correctio
  17. ns provided by Sun (collectively "Software"), by the number
  18. of users and the class of computer hardware for which the
  19. corresponding fee has been paid.
  20. 2. RESTRICTIONS. Software is confidential and copyrighted
  21. . Title to Software and all associated intellectual propert
  22. y rights is retained by Sun and/or its licensors. Except a
  23. s specifically authorized in any Supplemental License Terms
  24. , you may not make copies of Software, other than a single
  25. copy of Software for archival purposes. Unless enforcement
  26. is prohibited by applicable law, you may not modify, decom
  27. pile, or reverse engineer Software. Licensee acknowledges
  28. that Licensed Software is not designed or intended for use
  29. in the design, construction, operation or maintenance of an
  30. y nuclear facility. Sun Microsystems, Inc. disclaims any ex
  31. press or implied warranty of fitness for such uses. No ri
  32. ght, title or interest in or to any trademark, service mark
  33. , logo or trade name of Sun or its licensors is granted und
  34. er this Agreement.
  35. 3. LIMITED WARRANTY. Sun warrants to you that for a perio
  36. d of ninety (90) days from the date of purchase, as evidenc
  37. ed by a copy of the receipt, the media on which Software is
  38. furnished (if any) will be free of defects in materials an
  39. d workmanship under normal use. Except for the foregoing,
  40. Software is provided "AS IS". Your exclusive remedy and Su
  41. n's entire liability under this limited warranty will be at
  42. Sun's option to replace Software media or refund the fee p
  43. aid for Software.
  44. 4. DISCLAIMER OF WARRANTY. UNLESS SPECIFIED IN THIS AGREE
  45. MENT, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AN
  46. D WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABI
  47. LITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT
  48. ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT THESE DISCLAIMERS
  49. ARE HELD TO BE LEGALLY INVALID.
  50. 5. LIMITATION OF LIABILITY. TO THE EXTENT NOT PROHIBITED
  51. BY LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR
  52. ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT
  53. , CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CA
  54. USED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF
  55. OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE, EVEN
  56. IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
  57. . In no event will Sun's liability to you, whether in cont
  58. ract, tort (including negligence), or otherwise, exceed the
  59. amount paid by you for Software under this Agreement. The
  60. foregoing limitations will apply even if the above stated
  61. warranty fails of its essential purpose.
  62. 6. Termination. This Agreement is effective until termina
  63. ted. You may terminate this Agreement at any time by destr
  64. oying all copies of Software. This Agreement will terminat
  65. e immediately without notice from Sun if you fail to comply
  66. with any provision of this Agreement. Upon Termination, y
  67. ou must destroy all copies of Software.
  68. 7. Export Regulations. All Software and technical data del
  69. ivered under this Agreement are subject to US export contro
  70. l laws and may be subject to export or import regulations i
  71. n other countries. You agree to comply strictly with all s
  72. uch laws and regulations and acknowledge that you have the
  73. responsibility to obtain such licenses to export, re-export
  74. , or import as may be required after delivery to you.
  75. 8. U.S. Government Restricted Rights. If Software is bein
  76. g acquired by or on behalf of the U.S. Government or by a U
  77. .S. Government prime contractor or subcontractor (at any ti
  78. er), then the Government's rights in Software and accompany
  79. ing documentation will be only as set forth in this Agreeme
  80. nt; this is in accordance with 48 CFR 227.7201 through 227.
  81. 7202-4 (for Department of Defense (DOD) acquisitions) and w
  82. ith 48 CFR 2.101 and 12.212 (for non-DOD acquisitions).
  83. 9. Governing Law. Any action related to this Agreement wi
  84. ll be governed by California law and controlling U.S. feder
  85. al law. No choice of law rules of any jurisdiction will ap
  86. ply.
  87. 10. Severability. If any provision of this Agreement is hel
  88. d to be unenforceable, this Agreement will remain in effect
  89. with the provision omitted, unless omission would frustrat
  90. e the intent of the parties, in which case this Agreement w
  91. ill immediately terminate.
  92. 11. Integration. This Agreement is the entire agreement be
  93. tween you and Sun relating to its subject matter. It super
  94. sedes all prior or contemporaneous oral or written communic
  95. ations, proposals, representations and warranties and preva
  96. ils over any conflicting or additional terms of any quote,
  97. order, acknowledgment, or other communication between the p
  98. arties relating to its subject matter during the term of th
  99. is Agreement. No modification of this Agreement will be bi
  100. nding, unless in writing and signed by an authorized repres
  101. entative of each party.
  102. JAVA(TM) INTERFACE CLASSES
  103. J2EE(TM) DEPLOYMENT SPECIFICATION INTERFACE CLASSES 1.1
  104. SUPPLEMENTAL LICENSE TERMS
  105. These supplemental license terms ("Supplemental Terms") add
  106. to or modify the terms of the Binary Code License Agreemen
  107. t (collectively, the "Agreement"). Capitalized terms not de
  108. fined in these Supplemental Terms shall have the same meani
  109. ngs ascribed to them in the Agreement. These Supplemental T
  110. erms shall supersede any inconsistent or conflicting terms
  111. in the Agreement, or in any license contained within the So
  112. ftware.
  113. 1. Software Internal Use and Development License Grant. Sub
  114. ject to the terms and conditions of this Agreement, includi
  115. ng, but not limited to Section 3 (Java(TM) Technology Restr
  116. ictions) of these Supplemental Terms, Sun grants you a non-
  117. exclusive, non-transferable, limited license to reproduce i
  118. nternally and use internally the binary form of the Softwar
  119. e, complete and unmodified, for the sole purpose of designi
  120. ng, developing and testing your Java applets and applicatio
  121. ns ("Programs").
  122. 2. License to Distribute Software. In addition to the lice
  123. nse granted in Section 1 (Software Internal Use and Develop
  124. ment License Grant) of these Supplemental Terms, subject to
  125. the terms and conditions of this Agreement, including but
  126. not limited to Section 3 (Java Technology Restrictions), Su
  127. n grants you a non-exclusive, non-transferable, limited lic
  128. ense to reproduce and distribute the Software in binary for
  129. m only, provided that you (i) distribute the Software compl
  130. ete and unmodified and only bundled as part of your Program
  131. s, (ii) do not distribute additional software intended to r
  132. eplace any component(s) of the Software, (iii) do not remov
  133. e or alter any proprietary legends or notices contained in
  134. the Software, (iv) only distribute the Software subject to
  135. a license agreement that protects Sun's interests consisten
  136. t with the terms contained in this Agreement, and (v) agree
  137. to defend and indemnify Sun and its licensors from and aga
  138. inst any damages, costs, liabilities, settlement amounts an
  139. d/or expenses (including attorneys' fees) incurred in conne
  140. ction with any claim, lawsuit or action by any third party
  141. that arises or results from the use or distribution of any
  142. and all Programs and/or Software.
  143. 3. Java Technology Restrictions. You may not modify the Jav
  144. a Platform Interface ("JPI", identified as classes containe
  145. d within the "java" package or any subpackages of the "java
  146. " package), by creating additional classes within the JPI o
  147. r otherwise causing the addition to or modification of the
  148. classes in the JPI. In the event that you create an additi
  149. onal class and associated API(s) which (i) extends the func
  150. tionality of the Java Platform, and (ii) is exposed to thir
  151. d party software developers for the purpose of developing a
  152. dditional software which invokes such additional API, you m
  153. ust promptly publish broadly an accurate specification for
  154. such API for free use by all developers. You may not create
  155. , or authorize your licensees to create additional classes,
  156. interfaces, or subpackages that are in any way identified
  157. as "java", "javax", "sun" or similar convention as specifie
  158. d by Sun in any naming convention designation.
  159. 4. Trademarks and Logos. You acknowledge and agree as betwe
  160. en you and Sun that Sun owns the SUN, SOLARIS, JAVA, JINI,
  161. FORTE, and iPLANET trademarks and all SUN, SOLARIS, JAVA, J
  162. INI, FORTE, and iPLANET-related trademarks, service marks,
  163. logos and other brand designations ("Sun Marks"), and you a
  164. gree to comply with the Sun Trademark and Logo Usage Requir
  165. ements currently located at http://www.sun.com/policies/tra
  166. demarks. Any use you make of the Sun Marks inures to Sun's
  167. benefit.
  168. 5. Source Code. Software may contain source code that is pr
  169. ovided solely for reference purposes pursuant to the terms
  170. of this Agreement. Source code may not be redistributed un
  171. less expressly provided for in this Agreement.
  172. 6. Termination for Infringement. Either party may termina
  173. te this Agreement immediately should any Software become, o
  174. r in either party's opinion be likely to become, the subjec
  175. t of a claim of infringement of any intellectual property r
  176. ight.
