  10. Statement of Purpose
  11. The laws of most jurisdictions throughout the world automatically
  12. confer exclusive Copyright and Related Rights (defined below) upon the
  13. creator and subsequent owner(s) (each and all, an "owner") of an
  14. original work of authorship and/or a database (each, a "Work").
  15. Certain owners wish to permanently relinquish those rights to a Work
  16. for the purpose of contributing to a commons of creative, cultural and
  17. scientific works ("Commons") that the public can reliably and without
  18. fear of later claims of infringement build upon, modify, incorporate
  19. in other works, reuse and redistribute as freely as possible in any
  20. form whatsoever and for any purposes, including without limitation
  21. commercial purposes. These owners may contribute to the Commons to
  22. promote the ideal of a free culture and the further production of
  23. creative, cultural and scientific works, or to gain reputation or
  24. greater distribution for their Work in part through the use and
  25. efforts of others.
  26. For these and/or other purposes and motivations, and without any
  27. expectation of additional consideration or compensation, the person
  28. associating CC0 with a Work (the "Affirmer"), to the extent that he or
  29. she is an owner of Copyright and Related Rights in the Work,
  30. voluntarily elects to apply CC0 to the Work and publicly distribute
  31. the Work under its terms, with knowledge of his or her Copyright and
  32. Related Rights in the Work and the meaning and intended legal effect
  33. of CC0 on those rights.
  34. 1. Copyright and Related Rights. A Work made available under CC0 may
  35. be protected by copyright and related or neighboring rights
  36. ("Copyright and Related Rights"). Copyright and Related Rights
  37. include, but are not limited to, the following:
  38. i. the right to reproduce, adapt, distribute, perform, display,
  39. communicate, and translate a Work;
  40. ii. moral rights retained by the original author(s) and/or
  41. performer(s);
  42. iii. publicity and privacy rights pertaining to a person's image
  43. or likeness depicted in a Work;
  44. iv. rights protecting against unfair competition in regards to a
  45. Work, subject to the limitations in paragraph 4(a), below;
  46. v. rights protecting the extraction, dissemination, use and reuse
  47. of data in a Work;
  48. vi. database rights (such as those arising under Directive 96/9/EC
  49. of the European Parliament and of the Council of 11 March 1996 on
  50. the legal protection of databases, and under any national
  51. implementation thereof, including any amended or successor version
  52. of such directive); and
  53. vii. other similar, equivalent or corresponding rights throughout
  54. the world based on applicable law or treaty, and any national
  55. implementations thereof.
  56. 2. Waiver. To the greatest extent permitted by, but not in
  57. contravention of, applicable law, Affirmer hereby overtly, fully,
  58. permanently, irrevocably and unconditionally waives, abandons, and
  59. surrenders all of Affirmer's Copyright and Related Rights and
  60. associated claims and causes of action, whether now known or unknown
  61. (including existing as well as future claims and causes of action), in
  62. the Work (i) in all territories worldwide, (ii) for the maximum
  63. duration provided by applicable law or treaty (including future time
  64. extensions), (iii) in any current or future medium and for any number
  65. of copies, and (iv) for any purpose whatsoever, including without
  66. limitation commercial, advertising or promotional purposes (the
  67. "Waiver"). Affirmer makes the Waiver for the benefit of each member of
  68. the public at large and to the detriment of Affirmer's heirs and
  69. successors, fully intending that such Waiver shall not be subject to
  70. revocation, rescission, cancellation, termination, or any other legal
  71. or equitable action to disrupt the quiet enjoyment of the Work by the
  72. public as contemplated by Affirmer's express Statement of Purpose.
  73. 3. Public License Fallback. Should any part of the Waiver for any
  74. reason be judged legally invalid or ineffective under applicable law,
  75. then the Waiver shall be preserved to the maximum extent permitted
  76. taking into account Affirmer's express Statement of Purpose. In
  77. addition, to the extent the Waiver is so judged Affirmer hereby grants
  78. to each affected person a royalty-free, non transferable, non
  79. sublicensable, non exclusive, irrevocable and unconditional license to
  80. exercise Affirmer's Copyright and Related Rights in the Work (i) in
  81. all territories worldwide, (ii) for the maximum duration provided by
  82. applicable law or treaty (including future time extensions), (iii) in
  83. any current or future medium and for any number of copies, and (iv)
  84. for any purpose whatsoever, including without limitation commercial,
  85. advertising or promotional purposes (the "License"). The License shall
  86. be deemed effective as of the date CC0 was applied by Affirmer to the
  87. Work. Should any part of the License for any reason be judged legally
  88. invalid or ineffective under applicable law, such partial invalidity
  89. or ineffectiveness shall not invalidate the remainder of the License,
  90. and in such case Affirmer hereby affirms that he or she will not (i)
  91. exercise any of his or her remaining Copyright and Related Rights in
  92. the Work or (ii) assert any associated claims and causes of action
  93. with respect to the Work, in either case contrary to Affirmer's
  94. express Statement of Purpose.
  95. 4. Limitations and Disclaimers.
  96. a. No trademark or patent rights held by Affirmer are waived,
  97. abandoned, surrendered, licensed or otherwise affected by this
  98. document.
  99. b. Affirmer offers the Work as-is and makes no representations or
  100. warranties of any kind concerning the Work, express, implied,
  101. statutory or otherwise, including without limitation warranties of
  102. title, merchantability, fitness for a particular purpose, non
  103. infringement, or the absence of latent or other defects, accuracy,
  104. or the present or absence of errors, whether or not discoverable,
  105. all to the greatest extent permissible under applicable law.
  106. c. Affirmer disclaims responsibility for clearing rights of other
  107. persons that may apply to the Work or any use thereof, including
  108. without limitation any person's Copyright and Related Rights in
  109. the Work. Further, Affirmer disclaims responsibility for obtaining
  110. any necessary consents, permissions or other rights required for
  111. any use of the Work.
  112. d. Affirmer understands and acknowledges that Creative Commons is
  113. not a party to this document and has no duty or obligation with
  114. respect to this CC0 or use of the Work.
