  14. 1. DEFINITIONS

  23. not be considered an Adaptation for the purpose of this License.
  24. For the avoidance of doubt, where the Work is a musical work,
  25. performance or phonogram, the synchronization of the Work in
  26. timed-relation with a moving image ("synching") will be
  27. considered an Adaptation for the purpose of this License.
  28. b. "Collection" means a collection of literary or artistic
  29. works, such as encyclopedias and anthologies, or performances,
  30. phonograms or broadcasts, or other works or subject matter other
  31. than works listed in Section 1(f) below, which, by reason of the
  32. selection and arrangement of their contents, constitute
  33. intellectual creations, in which the Work is included in its
  34. entirety in unmodified form along with one or more other
  35. contributions, each constituting separate and independent works
  36. in themselves, which together are assembled into a collective
  37. whole. A work that constitutes a Collection will not be
  38. considered an Adaptation (as defined above) for the purposes of
  39. this License.
  40. c. "Distribute" means to make available to the public the
  41. original and copies of the Work or Adaptation, as appropriate,

  43. ownership.
  44. d. "Licensor" means the individual, individuals, entity or
  45. entities that offer(s) the Work under the terms of this License.

  60. digital form, such as a book, pamphlet and other writing; a
  61. lecture, address, sermon or other work of the same nature; a
  62. dramatic or dramatico-musical work; a choreographic work or
  63. entertainment in dumb show; a musical composition with or
  64. without words; a cinematographic work to which are assimilated

  73. as a copyrightable work; or a work performed by a variety or
  74. circus performer to the extent it is not otherwise considered a
  75. literary or artistic work.
  76. g. "You" means an individual or entity exercising rights under
  77. this License who has not previously violated the terms of this
  78. License with respect to the Work, or who has received express
  79. permission from the Licensor to exercise rights under this
  80. License despite a previous violation.
  81. h. "Publicly Perform" means to perform public recitations of the
  82. Work and to communicate to the public those public recitations,
  83. by any means or process, including by wire or wireless means or
  84. public digital performances; to make available to the public
  85. Works in such a way that members of the public may access these
  86. Works from a place and at a place individually chosen by them;

  92. i. "Reproduce" means to make copies of the Work by any means

  94. the right of fixation and reproducing fixations of the Work,
  95. including storage of a protected performance or phonogram in
  96. digital form or other electronic medium.
  97. j. "Software" means any digital Work which, through use of a
  98. third-party piece of Software or through the direct usage of
  99. itself on a computer system, the memory of the computer is
  100. modified dynamically or semi-dynamically. "Software",
  101. secondly, processes or interprets information.
  102. k. "Source Code" means the human-readable form of Software
  103. through which the Original Author and/or Distributor originally
  104. created, derived, and/or modified it.
  105. l. "Web Service" means the use of a piece of Software to
  106. interpret or modify information that is subsequently and directly
  107. served to users over the Internet.
  108. 2. FAIR DEALING RIGHTS
  109. Nothing in this License is intended to reduce, limit, or restrict any
  110. uses free from copyright or rights arising from limitations or
  111. exceptions that are provided for in connection with the copyright
  112. protection under copyright law or other applicable laws.
  113. 3. LICENSE GRANT
  114. Subject to the terms and conditions of this License, Licensor hereby
  115. grants You a worldwide, royalty-free, non-exclusive, perpetual (for the
  116. duration of the applicable copyright) license to exercise the rights in
  117. the Work as stated below:
  118. a. to Reproduce the Work, to incorporate the Work into one or
  119. more Collections, and to Reproduce the Work as incorporated in
  120. the Collections;
  121. b. to create and Reproduce Adaptations provided that any such

  125. example, a translation could be marked "The original work was

  135. Section 8(g), all rights not expressly granted by Licensor are
  136. hereby reserved, including but not limited to the rights set
  137. forth in Section 4(h).
  138. 4. RESTRICTIONS
  139. The license granted in Section 3 above is expressly made subject to and
  140. limited by the following restrictions:
  141. a. You may Distribute or Publicly Perform the Work only under
  142. the terms of this License. You must include a copy of, or the
  143. Uniform Resource Identifier (URI) for, this License with every
  144. copy of the Work You Distribute or Publicly Perform. You may not
  145. offer or impose any terms on the Work that restrict the terms of
  146. this License or the ability of the recipient of the Work to
  147. exercise the rights granted to that recipient under the terms of
  148. the License. You may not sublicense the Work. You must keep

  175. c. If the Work meets the definition of Software, You may exercise
  176. the rights granted in Section 3 only if You provide a copy of the
  177. corresponding Source Code from which the Work was derived in digital
  178. form, or You provide a URI for the corresponding Source Code of
  179. the Work, to any recipients upon request.
  180. d. If the Work is used as or for a Web Service, You may exercise
  181. the rights granted in Section 3 only if You provide a copy of the
  182. corresponding Source Code from which the Work was derived in digital
  183. form, or You provide a URI for the corresponding Source Code to the
  184. Work, to any recipients of the data served or modified by the Web
  185. Service.
  186. e. You may exercise the rights granted in Section 3 for
  187. commercial purposes only if you statisy any of the following:
  188. i. You are a worker-owned business or worker-owned
  189. collective; and
  190. ii. after tax, all financial gain, surplus, profits and
  191. benefits produced by the business or collective are
  192. distributed among the worker-owners
  193. iii. You are not using such rights on behalf of a business
  194. other than those specified in 4(e.i) and elaborated upon in
  195. 4(e.ii), nor are using such rights as a proxy on behalf of a
  196. business with the intent to circumvent the aformentioned
  197. restrictions on such a business.
  198. f. Any use by a business that is privately owned and managed,
  199. and that seeks to generate profit from the labor of employees
  200. paid by salary or other wages, is not permitted under this
  201. license.
  202. g. If You Distribute, or Publicly Perform the Work or any
  203. Adaptations or Collections, You must, unless a request has been
  204. made pursuant to Section 4(a), keep intact all copyright notices

  240. right to collect such royalties for any exercise by You of

  244. through any statutory or compulsory licensing scheme can
  245. be waived, the Licensor reserves the exclusive right to
  246. collect such royalties for any exercise by You of the

  283. ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW
  284. THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO
  285. YOU.
  286. 6. LIMITATION ON LIABILITY
  287. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL
  288. LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL,
  289. INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF
  290. THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED
  291. OF THE POSSIBILITY OF SUCH DAMAGES.
  292. 7. TERMINATION
  293. a. This License and the rights granted hereunder will terminate
  294. automatically upon any breach by You of the terms of this
  295. License. Individuals or entities who have received Adaptations
  296. or Collections from You under this License, however, will not
  297. have their licenses terminated provided such individuals or
  298. entities remain in full compliance with those licenses. Sections
  299. 1, 2, 5, 6, 7, and 8 will survive any termination of this
  300. License.
  301. b. Subject to the above terms and conditions, the license
  302. granted here is perpetual (for the duration of the applicable
  303. copyright in the Work). Notwithstanding the above, Licensor
  304. reserves the right to release the Work under different license
  305. terms or to stop distributing the Work at any time; provided,
